View previous versionsThese Terms and Conditions govern access to and use of Omatic Minds, including the public website at omatic-minds.com, the app at app.omatic-minds.com, public Mind share pages, optional public Mind password locks, guest Mind chats, member Mind chats, registered accounts, AI workspaces, Minds, conversations, memories, Image Studio, uploaded reference images, generated images, plan features, paid subscriptions, social login, AI provider routing, legal notices, reports, moderation tools, and related software or services.
These Terms are written for Omatic Minds and are intended to align with a Texas-based AI workspace service. They should be reviewed by a qualified attorney before being treated as final legal advice or final contract language.
By accessing or using Omatic Minds, visiting the public website, viewing a public Mind page, unlocking a password-protected public Mind, using a guest Mind chat, creating an account, signing in, connecting a provider, using AI features, using Image Studio, subscribing to a plan, or using any part of the service, the user agrees to these Terms and the Privacy Policy. If a user does not agree, the user should not use the service.
Users must be at least 13 years old or the minimum age required by applicable law to use the service. Users under 18 should have permission from a parent or legal guardian. A person using Omatic Minds on behalf of a company, organization, client, or another person represents that the person has authority to accept these Terms for that party.
Users must provide accurate account information and keep login credentials secure. Users may not share credentials, sell account access, allow unauthorized use, or use another person's account without permission. Users are responsible for activity that occurs under their account unless applicable law says otherwise.
Omatic Minds may restrict certain account changes, including email changes, when needed to protect login, billing, legal notice, connected-provider, or security integrity.
Omatic Minds may support different role types, plan levels, admin permissions, creator/business profile settings, streamer/gamer profile features, free access, paid access, public Mind sharing, Image Studio model access, and owner/super-admin tools. Role and plan level may control access to Minds, conversations, memories, provider choices, image models, reference-capable models, billing tools, admin tools, legal tools, and other features.
Subject to these Terms, users may access and use Omatic Minds for lawful AI-assisted productivity, drafting, planning, research support, workspace organization, content generation, business support, image generation, public Mind sharing, and other supported use cases. Users must comply with applicable laws, these Terms, the Privacy Policy, and any posted policies, limits, provider rules, or product instructions.
Users may not use Omatic Minds to do anything illegal, harmful, abusive, deceptive, infringing, privacy-invasive, or security-threatening. Prohibited conduct includes violating another person's rights, submitting malicious code, attempting unauthorized access, bypassing rate limits or plan limits, scraping protected app areas, reverse engineering restricted service components, interfering with service operations, misrepresenting AI output as human-created where disclosure is required, abusing billing systems, exploiting provider credentials, using public Mind pages for harassment or impersonation, uploading images the user has no right to use, or using the service to harm users, Omatic Minds, providers, or the public.
Where Public Mind features are enabled, a creator may set a Mind to private or public. Private Minds are intended for the creator or authorized app access only. Public Minds create a public-facing share page and shareable URL that may be viewed by people who have or discover the link, subject to password locks, access rules, moderation, and availability.
Creators are responsible for the Mind name, description, purpose, personality, response style, allowed topics, boundaries, public-safe profile fields, and other content they choose to make public. Public Mind pages must not be used to publish private personal data, confidential business data, regulated information, hidden system instructions, private memory notes, illegal content, infringing content, deceptive content, or content that violates these Terms.
Omatic Minds does not guarantee that a public Mind page will remain available, indexed, unindexed, cached, unpublished, or unchanged. Public pages may be copied, linked, screenshotted, cached, or shared by others outside Omatic Minds. Users should not place information on a public Mind page unless they are comfortable with that information being publicly accessible.
Where optional public Mind password locks are available, a creator may set, change, or remove a password for a public Mind page. Password locks are intended as a basic access barrier for the public share page. They are not a guarantee of complete confidentiality, encryption, or prevention of copying, screenshots, sharing, caching, or unauthorized disclosure by someone who has access.
Creators should not use public Mind password locks to store or publish highly sensitive, regulated, confidential, or mission-critical information. Omatic Minds may remove or bypass a public password lock when needed for lawful administration, security, legal compliance, abuse review, or owner/super-admin moderation.
Public Mind pages may include reporting tools or other abuse-prevention features. Omatic Minds may review reports, investigate public Mind pages, unpublish a Mind, restrict visibility, remove content, suspend accounts, preserve evidence, or take other action when Omatic Minds believes content or behavior may violate these Terms, threaten safety, infringe rights, create legal risk, abuse AI providers, or harm the platform.
Creators may be able to unpublish their own public Minds. Admin, owner, or super-admin accounts may also unpublish public Minds or restrict public access without prior notice when needed to protect users, the public, the service, providers, or legal interests.
Guest Mind chats may provide limited access without a registered account and may be rate-limited, changed, logged, or disabled for safety, abuse prevention, cost control, or product reasons. Member Mind chats and registered workspaces may include saved conversations, memories, plan limits, provider access, account history, and other account-connected features.
If public Mind chat or public participation features are enabled later, those features may be subject to additional rate limits, safety review, output review, usage logging, abuse limits, login prompts, creator controls, and super-admin shutoff controls. Public chat users must not attempt to extract private owner data, hidden system instructions, private memory notes, provider credentials, or restricted information.
Users may submit prompts, text, files where enabled, reference images, profile content, business content, Mind instructions, public Mind fields, memory notes, messages, feedback, reports, and other materials to the service. Users may receive AI-generated responses, summaries, drafts, classifications, recommendations, generated images, image variations, or other outputs. Input and output are together referred to as user content for these Terms.
Users are responsible for their content, including making sure they have the rights, licenses, permissions, and authority needed to submit, upload, generate from, use, publish, or rely on that content. Users must not submit content that violates law, infringes rights, exposes confidential data without authority, violates provider rules, or violates these Terms.
As between the user and Omatic Minds, users retain rights they have in their own input. To the extent allowed by law and provider rules, users may use the AI output generated for them, subject to these Terms and any third-party provider restrictions.
Users grant Omatic Minds the permission needed to host, store, process, transmit, display, route, transform, generate, back up, secure, troubleshoot, moderate, publish when the user chooses public visibility, and otherwise use submitted content to operate the service, provide AI responses, maintain Minds and conversations, support memories, operate Image Studio, enforce limits, process billing, send legal notices, provide support, prevent misuse, comply with law, and protect the platform.
Image Studio may allow users to generate images, use selected image models, upload reference images, create image variations, save generated outputs, download generated files, and maintain generation history depending on plan level and provider availability. Users are responsible for prompts, uploads, reference images, generated images, and any use or publication of generated images.
Users may not upload or generate images that violate law, infringe rights, misuse a person's likeness, expose private or sensitive data without authority, impersonate others deceptively, violate provider rules, or violate these Terms. Users should review generated images before using, publishing, or relying on them. Generated images may be inaccurate, offensive, similar to outputs received by other users, or unsuitable for a specific use.
Image Studio files may be subject to storage limits, download windows, cleanup windows, deletion, failed-generation cleanup, or administrator maintenance. Omatic Minds may keep audit or usage records even after a generated file or reference upload is no longer downloadable.
Because AI systems can generate similar responses or images for different users, output may not be unique. Other users may receive similar or identical output. Omatic Minds does not guarantee that AI output will be unique, accurate, complete, lawful, non-infringing, appropriate, or suitable for a particular purpose.
AI and machine learning systems can produce inaccurate, incomplete, outdated, biased, offensive, or misleading output. Users must evaluate output for accuracy and appropriateness before relying on it, publishing it, or using it in a workflow. Users should not rely on Omatic Minds output as the sole source of truth or as a substitute for professional advice.
Users must not use AI output relating to a person as the sole basis for decisions that have legal or material impact on that person, including decisions involving employment, housing, credit, lending, education, insurance, health care, criminal justice, public benefits, legal rights, safety, or similar important areas.
Omatic Minds is not a law firm, medical provider, financial adviser, tax adviser, security auditor, compliance consultant, or other licensed professional service. AI output and app content are provided for general productivity and informational support only. Users should consult qualified professionals before making legal, medical, financial, tax, compliance, security, or other professional decisions.
Omatic Minds may connect to third-party AI model providers, image generation providers, local model environments, social login providers, payment processors, email providers, analytics tools, security tools, hosting providers, and other services. Third-party services may have their own terms, privacy policies, rate limits, outages, data practices, content rules, and pricing. Omatic Minds is not responsible for third-party provider availability, provider-side decisions, provider output, provider download access, or provider terms.
AI provider access may be enabled, disabled, tested, limited, or changed by plan, role, model, safety setting, provider readiness, cost control, or admin configuration. Users may not attempt to access provider routes, models, reference routing, API keys, or plan-restricted capabilities that are not enabled for their account.
When users connect providers such as Google, Discord, GitHub, Twitter/X, LinkedIn, Twitch, or future supported services, users authorize Omatic Minds to use the connection for login, registration, account linking, or related app features. Users are responsible for keeping provider accounts secure and for unlinking providers they no longer want connected where unlink tools are available.
Some Omatic Minds features may depend on plan level, role type, active membership, billing status, provider access, usage limits, enabled settings, or admin configuration. Plan limits may apply to Minds, conversations, memories, model/provider access, image generation, reference-capable image generation, rate limits, credits, storage, public sharing, or other features. Omatic Minds may enforce limits, block actions above the active plan allowance, or change plan packaging as the product develops.
Paid plans may be processed through Stripe or another payment provider. Users must provide complete and accurate billing information and maintain a valid payment method when a paid subscription is active. Subscription charges may renew automatically according to the selected billing interval until canceled. Users are responsible for taxes, fees, and charges required by law or payment-provider rules.
If payment cannot be completed, Omatic Minds may downgrade, suspend, limit, or cancel paid access until payment is resolved. Billing portal availability, cancellation state, live/test Stripe status, subscription links, and payment review state may depend on the payment processor and app configuration.
Users may cancel paid access through the available billing tools or support process. Unless a separate refund policy says otherwise or applicable law requires otherwise, fees may be non-refundable once paid. Omatic Minds may change plan prices, plan packaging, or plan limits. If a material price increase affects an active subscription, Omatic Minds should provide reasonable notice before the increase applies at renewal when required or appropriate.
If Omatic Minds later offers credits, trials, promotional access, discounts, beta access, one-time grants, image generation credits, provider credits, or public sharing promotions, those benefits may expire, be limited, be non-transferable, and be subject to additional rules. Abuse of promotions or credits may result in removal of the benefit or account restriction.
Owner, super-admin, and admin tools are intended only for authorized site management. Users with admin access must protect sensitive settings, avoid unauthorized data access, keep provider credentials secure, use billing and legal tools carefully, use public unpublish and report tools responsibly, and avoid exposing private user information without a valid reason.
Omatic Minds may suspend, restrict, downgrade, unpublish, remove public access, or terminate access if a user violates these Terms, misuses the service, creates security risk, fails to pay required fees, causes harm, violates law, abuses AI providers, abuses public Mind pages, abuses billing or social login systems, or creates operational risk. Users may stop using the service at any time and may contact support about account issues where account tools are not available.
If a user believes an account restriction, suspension, downgrade, public unpublish action, or termination was made in error, the user may contact Omatic Minds through the available support method. Omatic Minds may review the request but does not guarantee restoration unless required by law or written agreement.
Omatic Minds may update, improve, limit, suspend, discontinue, rename, redesign, or change parts of the service as the platform grows. Changes may occur because of product development, security needs, AI provider changes, legal requirements, billing changes, infrastructure limitations, public safety needs, or operational needs. If a paid feature is discontinued in a way that materially affects prepaid access, Omatic Minds should provide reasonable notice or remedy when appropriate or required by law.
Omatic Minds, the site design, logos, branding, software, interface, systems, templates, code, documentation, content, and service materials are owned by Omatic Minds or its licensors unless otherwise stated. Users may not copy, resell, sublicense, distribute, modify, scrape, or misuse protected service materials except as allowed by these Terms or written permission.
If users provide feedback, suggestions, bug reports, feature ideas, design comments, reports, or improvement requests, Omatic Minds may use that feedback to improve, develop, market, moderate, or operate the service without owing compensation, unless a separate written agreement says otherwise.
If a user believes content on Omatic Minds infringes intellectual property rights, the user may contact Omatic Minds through the listed support or legal contact method with enough information to identify the copyrighted work, the allegedly infringing material, the user's contact details, a good-faith statement, an accuracy statement, and confirmation that the user is the owner or authorized to act for the owner. Omatic Minds may remove or restrict content that it believes is infringing or violates these Terms.
To the fullest extent allowed by law, Omatic Minds is provided on an “as is” and “as available” basis. Omatic Minds does not guarantee that the service will be uninterrupted, secure, accurate, error-free, always available, compatible with every provider, free from data loss, free from public content misuse, free from third-party copying, or suitable for every user purpose. Users accept that use of AI output, generated images, public Mind pages, and provider-connected features is at their own risk and that review, backups, and safe use are the user's responsibility.
To the fullest extent allowed by applicable law, Omatic Minds will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages; lost profits; lost revenue; lost goodwill; lost data; provider outages; AI output errors; generated image errors; public Mind misuse; billing-provider issues; business interruption; or unauthorized access caused by a user's failure to secure credentials. The maximum liability of Omatic Minds for claims relating to the service should be limited to the amount paid by the user for the service giving rise to the claim during the 12 months before the claim arose, or $100, whichever is greater, unless applicable law requires a different result.
If a user uses Omatic Minds on behalf of a business, organization, client, or other entity, that user and entity agree, to the fullest extent allowed by law, to protect and hold Omatic Minds harmless from claims, losses, liabilities, damages, costs, and expenses arising from misuse of the service, user content, public Mind content, uploaded images, generated images, violation of these Terms, violation of law, or violation of another person's rights.
Before filing a legal claim, the user and Omatic Minds should attempt to resolve the dispute informally by contacting the other party and describing the issue. Omatic Minds may use the email address associated with the user's account for dispute-related notices. If the dispute cannot be resolved informally within a reasonable period, either party may pursue available legal remedies.
These Terms are intended to be governed by the laws of the State of Texas to the extent allowed by applicable law, without regard to conflict-of-law rules. Unless applicable law requires a different forum, claims arising out of or relating to these Terms or Omatic Minds should be brought in the state or federal courts located in Texas with proper jurisdiction, including courts serving Harris County, Texas or the Southern District of Texas where appropriate.
Some consumer rights, mandatory local laws, small-claims rights, public injunctive relief rights, or other legal protections may still apply and cannot be limited by these Terms.
To the fullest extent allowed by law and subject to attorney review, disputes should be handled on an individual basis and not as a class, consolidated, or representative action. Any class action waiver, jury trial waiver, arbitration clause, or mass-action procedure should be reviewed by a Texas attorney before being treated as final or enforceable.
Users may not assign or transfer rights or obligations under these Terms without written permission. Omatic Minds may assign or transfer these Terms as part of a merger, acquisition, reorganization, financing, sale of assets, change of control, or transition of the service to another provider.
Users must comply with applicable sanctions, export control, and trade laws. Users may not use Omatic Minds in a way that violates trade restrictions or submit content requiring a government license for export or release unless the user has all required authorization.
Omatic Minds may update these Terms as the product, plans, billing, security practices, public Mind features, Image Studio features, AI providers, laws, or operational needs change. The current version, effective date, and previous versions may be made available through the public Terms page and Terms version archive. Material changes may be communicated by email, in-product notice, renewed acceptance, or another reasonable method when appropriate. If a user does not agree to updated Terms, the user should stop using the service.
These Terms, together with the Privacy Policy and any service-specific notices or written agreements that apply, make up the agreement between the user and Omatic Minds for use of the service. If any part of these Terms is found invalid or unenforceable, the remaining parts remain in effect to the fullest extent allowed by law. Failure to enforce a provision does not waive the right to enforce it later.
